Upzoned is a product of Buena Vista Vision, Inc., a California corporation ("Upzoned," "we," "us"). These terms are an agreement between you and Buena Vista Vision, Inc. An informational report, one parcel, one time
A paid verdict is a one-time $49 informational report that applies the published criteria of California SB 79 to a single parcel, using public sources: the statute, the ABAG/MTC summary and map, county parcel records, and transit station location data. The free address check tells you whether a paid verdict exists for your lot; it costs nothing and creates no obligation.
Your verdict speaks as of the date it is generated. SB 79 implementation is still moving: cities may adopt HCD-approved alternative plans, agencies may reclassify stops, and the Legislature may amend the statute. A verdict that was correct on the day it was issued may be affected by later changes, and we have no obligation to update reports already delivered.
We are not your lawyers
A verdict is a sourced statutory analysis — the statute's published tests applied to one parcel's public records, with the gray areas flagged instead of smoothed over. It is a starting point for diligence, not a substitute for it. If your verdict says UPZONED and you plan to act on it, your next call is a licensed land-use attorney, and the report is the brief you hand them.
Verify before you transact
We build every verdict carefully from the sources it cites, and we flag borderline results honestly — a parcel within a few dozen feet of a ring boundary gets a borderline flag and a recommendation to make a survey-grade measurement your first diligence step. Even so, public records contain errors, geocoding has tolerances, and the law changes.
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, and non-infringement. Before you buy, sell, borrow against, list, develop, or otherwise transact on a property, you agree to independently verify the facts that matter to your decision — with a land-use attorney, a surveyor, the city planning department, or all three. You agree not to treat a verdict as the sole basis for any transaction.
The free check is free. The paid verdict is guaranteed to arrive.
- Never charged for a free answer. If the free check can answer your question (outside every ring, outside coverage), we say so and charge nothing.
- Verdict never arrived, or we matched the wrong parcel? That is on us. Email hello@bossospro.com with your receipt within 30 days for a full refund.
- Unhappy for any other reason? Write us within 30 days of purchase and we will make it right — up to and including a full refund.
Refunds are issued to the original payment method through Stripe, usually within 5–10 business days.
Our liability is capped at what you paid
To the same extent, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost opportunities, diminution in property value, or losses arising from decisions you make in reliance on a verdict — even if we have been advised such damages are possible. This cap and these exclusions apply to all theories of liability (contract, tort, negligence, misrepresentation, statute, or otherwise) and survive even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations; where a limitation is not permitted, our liability is limited to the smallest amount the law allows.
Individual arbitration, California law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising out of or relating to these terms or the service will be resolved by binding arbitration on an individual basis, administered by JAMS under its streamlined rules, in San Mateo County, California (or by videoconference if you prefer). Judgment on the award may be entered in any court of competent jurisdiction.
You and we each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative proceeding. Either party may instead bring an individual claim in small claims court if it qualifies. You may opt out of this arbitration provision by emailing hello@bossospro.com within 30 days of your first purchase with the subject line "Arbitration opt-out."
What we collect and what we do with it
- Addresses you check are used to geocode the parcel, run the analysis, and improve coverage. They are not sold.
- Your email is used to deliver your verdict and receipt. If you tick the insights box, you also get three short notes about what SB 79 means for your property — then it stops. Unsubscribe anytime with one click or one email.
- Payments are processed by Stripe. Your card number never touches our servers.
- We do not sell your personal information, and we do not share it with third parties except the service providers who make the product run (payment, email, hosting).
To have your data deleted, email hello@bossospro.com from the address you used and we will remove it.
Changes, severability, the whole agreement
We may update these terms; the effective date above changes when we do, and the version in force when you purchase governs that purchase. If any provision is found unenforceable, the rest remain in effect. These terms are the entire agreement between you and Buena Vista Vision, Inc. regarding Upzoned and supersede any prior understanding. Failure to enforce a provision is not a waiver of it.
